AMF investigations: the Constitutional Council rules out the obligation to notify the right to remain silent

In a priority preliminary ruling on constitutionality regarding the constitutionality of Article L. 621-12, paragraph 1, of the Monetary and Financial Code in that it provides, in the context of a visit conducted by AMF agents, for the possibility of “collecting (…) explanations from the persons questioned during the visit, the Constitutional Council ruled out the obligation to notify the right to remain silent at this stage of the investigation.
