Full reparation does not mean unlimited reparation. If reparation is to ‘wipe out all the consequences of the illegal act’,[2] it should do just that. Except in very specific cases, which are not considered in this chapter,[3] damages cannot exceed the actual harm suffered as a consequence of the wrongful act.[4] This principle implies that limitations are imposed on the damages to be awarded as reparation, which go beyond the prohibition of double recovery.[5] Read more
